Land Title Documents

JPs now need to see three forms of identification when witnessing land title documents. One being a passport or birth certificate. Please refer to the instructions attached to the large JP Board. Department of Justice and Attorney-General, Justice of the Peace Branch.

Minimum Identification Document Requirements for Property Matters

  • Person: Verification of identity must be done face to face with The Identity Verifier ensuring that the Person being identified produces original Documents in one of the Categories starting with Category 1
  • Categories in order: The Identity Verifier must be reasonably satisfied that a prior Category can’t be met before selecting a subsequent Category
    Originals Only: The Identity Verifier must sight the originals of all Documents from the relevant Category
  • Evidence is Current: The Documents produced must be current, except for an expired Australian Passport which has not been cancelled and was current within the preceding 2 years

Minimum Document Requirements For Persons who are Australian citizens or residents

Category 1:

  • Australian Passport or foreign passport or Australian Evidence of Immigration Status
  • ImmiCard or Australian Migration Status ImmiCard
  • plus Australian drivers license or Photo Card
  • plus change of name or marriage certificate if necessary

Category 2:

  • Australian Passport or foreign passport or Australian Evidence of Immigration Status
  • ImmiCard or Australian Migration Status ImmiCard
  • plus full birth certificate or citizenship certificate or descent certificate
  • plus Medicare or Centrelink or Department of Veterans’ Affairs card
  • plus change of name or marriage certificate if necessary

Category 3:

  • Australian drivers license or Photo Card
  • plus full birth certificate or citizenship certificate or descent certificate
  • plus Medicare or Centrelink or Department of Veterans’ Affairs card
  • plus change of name or marriage certificate if necessary

Category 4:

  • (a) Australian Passport or foreign passport or Australian Evidence of Immigration Status ImmiCard or Australian Migration Status ImmiCard
    • plus another form of government issued photographic identity Document
    • plus change of name or marriage certificate if necessary
  • (b) Australian Passport or foreign passport or Australian Evidence of

  • (b) Identifier Declaration by a Person specified in Verification of Identity Standard paragraph 4.4 NOTE : Refer to Verification of Identity Standard paragraph 4

  • (a) Foreign Passport

    • plus change of name or marriage certificate if necessary

Large Court Files and Multi-Page Affidavits

As we would like to assist as many people as possible in our hours of operation, we are unable to process time consuming documents. Please ring the Court house for advice, or we ask that you take these to Australia Fair Justice of Peace service, who are better equipped to assist with longer opening hours and additional JPs on duty. One copy only of EPAs and multi-page documents. Please note our closing times, as these can take up to 20 mins each to complete.
